You are correct as to laws and Rules being different things. That said, if the Law grants the Unions closed status the Union Rules, BiLaws etc., determine who will, or in this case will not, work in the state.

If the Union does not defend this situation the ability to express it in the future becomes more difficult and lesser and lesser instances will get by such that the Law/Rule will no longer be enforceable either literally or practically... (Think Illegal Imigration)

I am pretty certain a sizeable number of nonUnion crews paid whatever and went to work as was intended.

That said too, we have property out on Long Island and hate to see ANY help turned away.....
